1 All advertising is accepted subject to compliance with the Australian law. Any ad that is considered to be suspicious, unethical, or illegal in any way will be deleted.

2 Private ads in Best Cars, Best Bikes, Best Boats, Best Caravans, Best Trucks, Best Machines and Best Parts must be from Australian advertisers. All items for sale must be located in Australia and available for inspection by potential buyers. All ads must include a local contact phone number. Ad content must not include unauthorised links to external URL.

3 All rates and fees are in Australian Dollar (AUD $) unless otherwise stated. Quoted rates and fees are subject to change without notice. Fees for all Bestcade Motorsm service include GST. Fees are non-refundable.

4 The customer is responsible for providing true, accurate, current and complete information to Bestcade Motorsm and notifying Bestcade Motorsm of any error when it appears. If any information provided by customer is untrue, inaccurate, not current or incomplete, Bestcade Motorsm reserves the right to suspend or terminate customer's account and refuse any and all current or future use of any Bestcade Motorsm service.

5 Bestcade Motorsm reserves the right to reject or cancel any advertisement considered suspect in anyway, including failure to provide full name, street address, valid local contact phone number, valid local email address or legitimate photos. Duplicate ads will be deleted.

6 Bestcade Motorsm reserves the right to reject any communication (email, phone, fax, post) received without proper identification(name) and contact details.

7 Private customers: payment for Bestcade Motorsm service should be made by credit cards (VISA, MASTERCARD). Bestcade Motorsm reserves the right to decline any payment where the customer's name do not match the name on card (business cards excepted). Customer account with Bestcade Motorsm will be permanently suspended in the event of any criminal activity, fraud or fraudulent use of credit card. Bestcade Motorsm service will commence after payment has been cleared and authorised.

8 Commercial customers: account must be paid within 14 days of the invoice date. Bestcade Motorsm may charge interest on all overdue amounts and may claim from the customer all costs associated with recovering the money.

9 The layout, size, placement of all advertisements including any necessary text editing, cropping and optimisation of photographs are entirely at the option of Bestcade Motorsm.

10 As well as publishing online, Bestcade Motorsm reserves the right to publish the advertisement in hard copy or in any other form.

11 Subject to conditions and for limited duration Bestcade Motorsm reserves the right to offer special discounts, run promotions and complementary listings in Bestcade Motorsm and affiliated sister websites including Opensm.com.au.

12 Bestcade Motorsm classifieds service rely on email communication to the customer. Bestcade Motorsm is not responsible and not liable for any delay or error in email transmission or reception caused by problems, faults or negligence on the part of the customer email server, customer email account, customer ISP connection, which are outside Bestcade Motorsm control.

13 The customer indemnifies Bestcade Motorsm against all claims, suits, liabilities, costs and expenses of any nature which is incurred by Bestcade Motorsm arising out of the customer advertisement or customer use of information provided from Bestcade Motorsm car quotation or car search service.

14 To the extent allowed by law, the liability of Bestcade Motorsm is limited. Bestcade Motorsm is not liable for loss or damage in respect of advertisement being displayed, altered, omitted or delayed . Bestcade Motorsm is not liable for any delay or failure to publish an advertisement due to an unforeseen, uncontrollable or unlawful circumstance such as industrial dispute, government or legal restraint, network or communication or server breakdown for whatever reason.

15 In the event of any customer dispute related to Bestcade Motorsm service, Bestcade Motorsm can not accept any further request for service or payment from the customer until the dispute has been resolved.

16 Bestcade Motorsm assumes no responsibility, and shall not be liable for any damages to, or viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in the Bestcade Motorsm Site, or your downloading of any materials, data, text, images, video, or audio from the Site.

17 Limitation on liabiity: the entire contents of the Bestcade Motorsm site are provided "as is" and Bestcade Motorsm makes no representations or warranties of any kind, express or implied, including, but not limited to fitness for a particular purpose or non-infringement of any kind with respect to this site or its contents. Neither Bestcade Motorsm nor any of its directors, officers, employees or representatives will be liable for damages of any kind arising out of or in connection with the use of this site or any of information contained herein, even if advised of the possibility thereof. To the extent allowed by law, any other liability of Bestcade Motorsm arising out of any Bestcade Motorsm service is limited to repayment of the original fee or $30 whichever is the lesser.
